Terms of Service
"You" in the following parts of the ToS represents "the commissioner" and is not meant to direct to any specific person, I used expressions such as "warn", and "report" in the T.o.S, but by no means am I assuming the commissioner would cause such actions as I trust in mutual respect, I apologize for any disturbance my usage of words caused.Please pay only after commission is accepted. I will not reject commissions based on design, but content (please refer to "personal don'ts"). • Only clear reference with color scheme is accepted unless you are commissioning customs, and I have the right to request clearer references and/or clarifications.
• Only in rare cases do I accept real life images or game sprites (pixelated or 3D modeled) as eligible and sole references.
• Special services (e.g. illustration, items not included in my commission option) will need to be negotiated.
• Payment plans are only available for purchase >$200. Please contact me if this is the case.
• I remain the right to submit commissioned pieces to other social media and sites.
• I reserve the right to interpret terms in the ToS the way I understand it. If there is any misunderstanding, please let me know so I can word the terms more professionally.Refunds
No refunds will be accepted other than cases that I cannot deliver due to changes in real-life. Payment will be requested either when initial sketch is done or upfront for smaller projects. Cancellation is accepted if no progress has been made. Please let me know if you would like wips, the default setting is no.Payment
Commission prices have already included fees. Tips are greatly appreciated. Transaction fees will be covered by the commissioner if the commissioner sent the wrong payment to the paypal email in question but will be covered by me if I have requested the wrong payment to the commissioner, and the commissioner has paid.Editting
I can edit the sketch/palette slightly upon request, if my note about the sketch is not replied to within 24 hours, I will simply move on with what I have. • Please be reasonable about edit requests
• If there is any request about pose, please inform me upfront, I will not do large edits such as changing from standing to sitting or vice versa as they frequently involve redrawing from scratch.
• After the artwork is complete, I will only make slight changes to colors and if there are any huge mistakes (e.g. hair or skin color, etc.), again, please be reasonable for any fixes, and please note me as soon as possible.Creditting
Please credit me if you use the commissioned piece in your profile/upload to other sites, and do not claim the art as your own! If uploading to toyhouse, please credit @/Nemukuri. • You are allowed to use your commissioned piece for personal use, i.e. desktop background, phone background, profile decoration, icons etc. with proper credit but any commercial use (e.g. fanzines) is not allowed. If you are using my art for such uses, please contact me personally before I start with your commission for discussion on logistics.
• I reserve the right to post the piece on any of my blogs and as commission/art examples as long as I do not receive request not to. If you want the commission to be 100% confidential and the art at your charge only, I will be charging a small fee, and will not be posting the art anywhere, please contact me personally.Timeframe of CompletionGenerally I will try to finish my commission within 1 month after commission invoice is paid, however, • I reserve the right to delay the commission without notification because of personal issues I have to deal with in real-life. If I feel unable to finish your commission due to reasons such as a) sickness/injury b) technical problems (such as tablet problems or computer breakdown) c) large changes in styles d) long term activities (such as training programs) and e) other urgent life issues I or others will be contacting you to cancel the commission and I will give full refunds. If WIPs are available, they will be sent to the commissioner for free.
• It's possible that I lose track of time and not inform you for delays. In that case, please check my To-do list (available on my Toyhouse profile) for your commission progress. Feel free to contact me for updates on the progress via email or through platforms that I am active on.Others • Heavy editting is not allowed without prior knowledge, please let me know beforehand and have my agreement. Creditting is still needed.
• If I see the commissioner fail to follow my terms, I will send the commissioner a warning note, if my warning is not regarded properly, the commissioner will be rejected to any of my future commissions/trades/collabs/giveaways/raffles/etc. Serious infringement (art stealing, tracing, severe editting without prior knowledge) will result in my reporting and blacklisting.
• I reserve the right to reject commissions if I feel the content is not proper or I don't feel competent in finishing your piece.
• Please confirm that there is no mistake in the commissioned piece (key designs, etc.). I will delete my file storage every once in a while (no more often than monthly). After this period the file is not able to be retrieved.
• Please be aware that my quality varies sometimes, I will try my best to finish with satisfying quality, however, best quality is not guaranteed.Thank you for reading!
